Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Dad & Baby website at dadandbaby.co.uk, the Dad & Baby application at app.dadandbaby.co.uk, and any associated mobile applications (together, the "Service"), operated by Dad & Baby Limited, a company registered in England and Wales (Company Number: 15984321) ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Definitions

  • "App"means the Dad & Baby web application at app.dadandbaby.co.uk and any native mobile applications distributed via the Apple App Store or Google Play Store.
  • "Service" means the App, the marketing website at dadandbaby.co.uk, and all features, content, and tools provided through them.
  • "User" or "you" means any individual who accesses or uses the Service.
  • "Content" means all text, information, tools, features, guides, and materials provided through the Service.
  • "DadPro" means the premium subscription tier of the Service offering additional features.
  • "Forum" means the community discussion feature within the App where users can post and interact anonymously.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By creating an account, you confirm that you are 18 or older.

The Service is designed primarily for users in the United Kingdom. Content including pregnancy guidance, NHS references, financial information, and benefits guidance is UK-specific and may not be applicable in other jurisdictions.

4. Account

The Service uses passwordless "magic link" authentication. When you sign in, a unique link is sent to your email address.

  • You may only create one account per person.
  • You are responsible for keeping your email address current and ensuring you have access to the email account used to register.
  • You must not share your authentication links with anyone else.
  • You accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice where necessary to protect the safety of our users or the integrity of the Service.

5. Medical Disclaimer — IMPORTANT

The App provides general health and pregnancy information for EDUCATIONAL PURPOSES ONLY.

  • The App is NOT a substitute for professional medical advice, diagnosis, or treatment.
  • ALWAYS seek the advice of your midwife, GP, or qualified healthcare professional with any questions about a medical condition, your partner's pregnancy, or your baby's health.
  • The contraction timer is a GUIDE ONLY. Always follow your healthcare team's advice on when to attend hospital.
  • Mental health self-assessments (including wellbeing check-ins) are screening tools, NOT clinical diagnoses. If you or your partner are struggling with mental health, please contact a professional or call Samaritans on 116 123 (free, 24/7).
  • Pregnancy risk information is educational and does not constitute medical diagnosis.
  • The immunisation tracker is a RECORD-KEEPING TOOL ONLY. It does not constitute medical advice on whether to vaccinate. Always follow your GP or health visitor's guidance regarding your child's immunisation schedule.
  • The emergency reference is a GUIDE ONLY. In any emergency, always call 999 immediately. Do not rely on the App as a substitute for emergency services.
  • Growth charts within the App are for personal tracking onlyand are not intended for clinical diagnosis. If you have concerns about your child's growth, consult your health visitor or GP.
  • Medication dosage presets are based on publicly available NHS guidance but always check dosages with your pharmacist or GP before administering any medication to your child.
  • The sleep and feeding tracker is for personal record-keeping onlyand does not constitute medical monitoring. If you have concerns about your baby's sleep or feeding, seek professional advice.
  • Developmental milestones are based on the ASQ-3 framework but do NOT replace professional developmental assessments. If you have concerns about your child's development, contact your health visitor or GP for a formal assessment.
  • In a medical emergency, call 999 immediately.
  • We accept NO LIABILITY for medical decisions made based on information in this App.

6. Financial Disclaimer

  • Financial information provided in the App (including benefits, JISA, childcare costs, and parental leave entitlements) is general guidance, NOT regulated financial advice.
  • Benefit rates and eligibility criteria may change. Always verify current information with GOV.UK or a qualified adviser.
  • The budget planner is an estimating tool only. Actual costs may vary significantly.
  • We are not regulated by the Financial Conduct Authority (FCA) and do not provide regulated financial advice.

7. User Content & Forum

The Forum allows you to post and interact with other users. Forum posts are displayed anonymously to other users but are identifiable to us for moderation and safety purposes.

By posting content on the Forum, you grant us a non-exclusive, royalty-free licence to display your content within the App for the purpose of operating the Forum.

When using the Forum, you must NOT:

  • Share identifying information about children (real names, photos, locations, school names, etc.).
  • Provide medical advice to other users — share your experiences, but do not diagnose or prescribe.
  • Post harassment, hate speech, threats, discrimination, or personal attacks.
  • Spam, self-promote, or post irrelevant commercial content.

We moderate all Forum content using AI screening (OpenAI) and human review. We reserve the right to remove content and suspend or permanently ban accounts without notice for violations.

8. DadPro Subscription

  • DadPro is available at £4.99/month, auto-renewing.
  • Subscriptions are managed entirely by the Apple App Store or Google Play Store. We do not process payments directly.
  • You may cancel at any time through your app store settings. Cancellation takes effect at the end of the current billing period.
  • Under the UK Consumer Contracts Regulations 2013, you have a 14-day cooling-off period from the date of purchase. However, by accessing digital content immediately upon subscription, you acknowledge that you may lose this cancellation right.
  • No refunds are provided after the cooling-off period for the current billing period.
  • We may change subscription pricing with at least 30 days' notice. You will be notified of any price changes before they take effect.

9. Intellectual Property

All content, features, design, branding, logos, and functionality of the Service are owned by Dad & Baby or our licensors and are protected by UK and international intellectual property laws.

Your personal data belongs to you. You may request its export or deletion at any time (see our Privacy Policy).

Pregnancy and health content within the App is sourced from public NHS guidance and other publicly available health resources. This content is adapted for the App and remains educational in nature.

10. Prohibited Use

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Scrape, data mine, or systematically extract content from the Service.
  • Impersonate any person or entity, or falsely represent your affiliation.
  • Use the Service for any illegal activity or in violation of applicable laws.
  • Attempt to access another user's account or data.
  • Upload or transmit any harmful code, viruses, or malicious software.
  • Interfere with or disrupt the Service, servers, or networks.

11. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we are NOT liable for:

  • Medical decisions made based on information in the App.
  • Financial decisions made based on information in the App.
  • Birth outcomes or pregnancy complications.
  • Relationship impacts.
  • Any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you shall not exceed the amount you have paid for DadPro in the preceding 12 months. If you have not paid for DadPro, our total liability shall not exceed £10.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Any other liability that cannot be excluded or limited under English law.

12. Indemnification

You agree to indemnify and hold harmless Dad & Baby, its officers, directors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your misuse of the Service or violation of these Terms.

13. Data Protection

Your personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.

You have rights under the UK GDPR including the right to access, rectify, and delete your personal data. Account deletion is available directly in the App (Settings > Delete Account) or by emailing privacy@dadandbaby.co.uk.

14. Termination

You may delete your account at any time through the App or by contacting us. Upon deletion, your data will be removed in accordance with our data retention policy (see Privacy Policy, Section 8).

We may suspend or terminate your access to the Service at our discretion if we believe you have violated these Terms. We will endeavour to notify you of the reasons for suspension or termination where reasonably practicable.

Sections of these Terms that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall continue in full force and effect.
